LINDENHURST, NY – A former school custodian in Suffolk County has been indicted on more than 100 charges after authorities say he sexually abused a child, recorded the abuse, and distributed the material online.
Brian Woehr, 40, a former employee of the Lindenhurst School District, was arraigned on May 14, 2025, on 113 counts, including Use of a Child in a Sexual Performance as a Sexually Motivated Felony, Sexual Abuse in the First Degree, and Promoting and Possessing a Sexual Performance by a Child.
According to Suffolk County District Attorney Raymond A. Tierney, forensic investigators identified Woehr after a tip was submitted to the National Center for Missing and Exploited Children and the New York State Internet Crimes Against Children Task Force.
Investigators executed a search warrant at Woehr’s home on April 30, where they seized a phone containing multiple files allegedly depicting the sexual abuse of a child. Some of those files were determined to have been created by Woehr himself.
Beyond the horrific trauma of the sexual abuse itself, this defendant allegedly recorded these despicable acts and distributed that material to others,” Tierney said in a statement. “Each view and share re-victimizes the child.”
The indictment includes two counts of Use of a Child in a Sexual Performance as a Sexually Motivated Felony, two counts of Use of a Child in a Sexual Performance, two counts of Sexual Abuse in the First Degree, 54 counts of Promoting a Sexual Performance by a Child, and 52 counts of Possessing a Sexual Performance by a Child. He is also charged with Endangering the Welfare of a Child.
Woehr was ordered held on $1.5 million cash bail, $5 million bond, or a $15 million partially secured bond. If convicted on the top charge, he faces up to 15 years in prison.
The investigation is being led by Detective Joseph Gonzalez of the Suffolk County Police Department Digital Forensics Unit. Prosecutors are encouraging anyone with additional information to contact the unit at 631-852-6279.
Woehr is due back in court on June 20. His attorney, Steve Fondulis, entered a not guilty plea on his behalf.
In addition to the recent indictment of Woehr, there was another notable incident involving a childcare worker in Lindenhurst earlier this year.
In March 2025, Megan Marchena, a 26-year-old employee at the Tutor Time daycare center in Lindenhurst, was arrested and charged with assault and endangering the welfare of a child. She allegedly pushed an 18-month-old child’s face into a cot, resulting in injuries that required stitches. Following the incident, Marchena and the program director were placed on administrative leave. The daycare center had previously been cited for multiple violations by the New York State Office of Children and Family Services between October 2022 and July 2024, including issues related to staff conduct and facility maintenance.
These incidents have raised concerns among parents and community members about the safety protocols and background checks in place for individuals working with children in educational and childcare settings in Lindenhurst.
