WESTBURY, N.Y. – A Glen Cove man has been arrested following allegations that he abused a child over the course of several years while employed at a Westbury daycare, according to Nassau County Police.

Detectives from the Special Victims Squad said that Jose Rodriguez, 49, of Glen Cove Avenue, is accused of inappropriately touching a boy beginning in 2016 when the child was 10 years old. The alleged abuse is said to have continued until 2020, when the victim was 13.

Police reported that earlier this month, on August 11, the victim encountered Rodriguez when the defendant entered a Dunkin’ Donuts where the now-young adult is employed. After Rodriguez left, the victim contacted authorities.

Rodriguez was taken into custody on August 25, 2025, in Glen Cove without incident. He has been charged with Course of Sexual Conduct Against a Child in the First Degree and Endangering the Welfare of a Child. He was scheduled to be arraigned the following day at First District Court in Hempstead.

Authorities emphasized that these charges are allegations and Rodriguez is presumed innocent until proven guilty.

Police are asking anyone who believes they may have been a victim to contact Nassau County Crime Stoppers at 1-800-244-TIPS or the Special Victims Squad at 516-573-4022. Calls will remain confidential.

Understanding the Charge: Course of Sexual Conduct Against a Child

In New York, Course of Sexual Conduct Against a Child is one of the most serious sexual offense charges in state law. It applies when a person is accused of engaging in repeated sexual acts with a child over a period of time, rather than a single incident.

  • First Degree (Penal Law §130.75):
    • Applies when the alleged victim is under 13 years old.
    • The accused is 18 years or older.
    • Involves two or more sexual acts (including sexual intercourse, oral sexual conduct, or other designated contact) over a period of at least three months.
    • Classified as a Class B felony, punishable by up to 25 years in prison.
  • Second Degree (Penal Law §130.80):
    • Applies when the alleged victim is under 11 years old.
    • Involves two or more acts of sexual conduct over at least three months.
    • Classified as a Class D felony, punishable by up to 7 years in prison.

Because of its structure, this law is used in cases where prosecutors allege long-term abuse rather than isolated incidents. Convictions under this charge almost always carry severe prison sentences and can also require mandatory registration as a sex offender.

Important: This story is categorized as a crime story and thus it is important to note that charges are accusations and defendants are presumed innocent until proven guilty in a court of law.
